本《可接受使用政策》(Acceptable Use Policy, 以下简称 "AUP") 是奇画 AI (qihuaai.com, 运营主体 Stellar Byte Tech Team / StellarByte, 加拿大不列颠哥伦比亚省注册) 服务条款的组成部分, 与《服务条款》《隐私政策》《退款政策》具有同等效力.

本平台为创作者提供 AI 生成工具, 但您对所有上传素材、输入的 prompt 与生成的产物负完全责任. 您应自行评估生成内容是否符合所在地法律法规、目标分发渠道的合规要求以及第三方权利人 (商标 / 版权 / 肖像权 / 隐私权) 的合法权益.

本平台保留对违规账号采取处置措施的全部权利, 包括但不限于实时拦截、删除内容、限流、警告、冻结、永久封号、配合执法披露用户信息.

This Acceptable Use Policy ("AUP") forms an integral part of qihuaai.com (operated by Stellar Byte Tech Team / StellarByte, incorporated in British Columbia, Canada) and has the same force as the Terms of Service, Privacy Policy and Refund Policy.

The Platform provides AI generation tools, but you bear sole responsibility for all uploaded materials, input prompts and generated outputs. You must independently evaluate whether the generated content complies with the laws of your jurisdiction, the compliance requirements of your distribution channels, and the lawful rights of third-party rights holders (trademark, copyright, portrait, privacy).

We reserve all rights to take action against violating accounts, including but not limited to real-time blocking, content removal, rate limiting, warnings, suspension, permanent ban and disclosure of user information to law enforcement.

2. 绝对禁止 (一次踩即永久封号)/ 2. Strictly Prohibited (Immediate Permanent Ban)

  • 未成年人不当内容: 生成、传播、检索任何涉及未成年人的色情、性化、剥削性内容 (CSAM), 不论真实还是 AI 合成, 不论是否带 "艺术" "教育" 标签. 一经发现, 立即永久封号 + 报送加拿大 NCECC (National Child Exploitation Crime Centre) 与美国 NCMEC.
  • 真实人物深度伪造 (Deepfake without consent): 未经本人书面授权生成或传播以真实自然人为对象的肖像、声音、行为深度伪造内容, 包括但不限于政治人物、公众人物、私人个体. 涉及色情类深度伪造 (deepfake porn) 一律永久封号 + 配合执法.
  • 暴力 / 恐怖主义内容: 策划、教学、协助制造常规 / 化学 / 生物 / 核武器、爆炸物、毒品的具体配方、工艺与改装方案; 宣扬恐怖主义、极端主义、武装暴力.
  • 仇恨言论 / 种族主义 / 系统性歧视: 基于种族、民族、国籍、性别、性取向、宗教、残疾等的仇恨言论、骚扰、暴力威胁、人肉搜索.
  • 政治敏感内容 (中国大陆 + 国际): 涉及国家领导人形象生成 / 政治事件再现 / 颠覆国家政权言论 / 选举干预 / 虚假政治新闻; 内容遵循中国《生成式人工智能服务管理暂行办法》《互联网信息服务深度合成管理规定》及目标分发地的政治合规要求.
  • 虚假信息 / 选举干预: 大规模生成虚假新闻、伪造证据、操纵舆论以干预选举或重大公共事务.
  • 知识产权侵权 (已知商标 / 版权角色): 在 prompt 中明确指名生成已知商标、迪士尼角色、漫威角色、宫崎骏角色、宝可梦等受版权或商标保护的人物 / 形象作商业用途.
  • 钓鱼 / 欺诈 / 恶意软件: 构造钓鱼网站、伪造证件、仿冒他人身份; 传播勒索病毒、间谍软件、键盘记录器; 撰写诱骗 / 诈骗用文案.
  • 未授权入侵 / 制裁规避: 未经授权进入他人系统; 为受联合国 / OFAC / 加拿大 SEMA 制裁实体或个人提供算力或推理服务; 协助洗钱.
  • 平台滥用: 规避计费、绕过 API Key 限制、批量薅充值返点、多账号套利、构造对抗样本攻击审核系统、批量自动化垃圾请求.
  • Improper content involving minors: generation, distribution or retrieval of any sexual, sexualized or exploitative content involving minors (CSAM), whether real or AI-synthesized, regardless of any "artistic" or "educational" framing. On discovery: immediate permanent ban plus reporting to the Canadian NCECC (National Child Exploitation Crime Centre) and the U.S. NCMEC.
  • Deepfakes of real persons without consent: generating or distributing deepfake portrait, voice or behavior content of real natural persons without written authorization, including but not limited to politicians, public figures and private individuals. Deepfake pornography results in permanent ban plus law-enforcement cooperation.
  • Violence / terrorism content: planning, instructing or assisting the manufacture of conventional / chemical / biological / nuclear weapons, explosives or narcotics, including specific formulations and modification schemes; promoting terrorism, extremism or armed violence.
  • Hate speech / racism / systemic discrimination: hate speech, harassment, threats of violence or doxxing based on race, ethnicity, nationality, gender, sexual orientation, religion, disability and similar protected characteristics.
  • Politically sensitive content (PRC + international): generation of national leader likenesses, political-event reenactments, content advocating subversion of state power, election interference, fake political news. Content must comply with the PRC Interim Measures for the Management of Generative AI Services, the Provisions on the Administration of Deep Synthesis Internet Services, and the political-compliance requirements of any distribution jurisdiction.
  • Disinformation / election interference: mass generation of fake news, fabricated evidence or public-opinion manipulation aimed at interfering with elections or major public affairs.
  • IP infringement (known trademarks / copyrighted characters): prompts that explicitly request commercial use of known trademarks, Disney / Marvel / Studio Ghibli / Pokémon characters or similar copyright-protected likenesses.
  • Phishing / fraud / malware: constructing phishing sites, forging credentials, impersonating others; distributing ransomware, spyware, keyloggers; drafting fraud or scam copy.
  • Unauthorized intrusion / sanctions evasion: unauthorized access to others' systems; providing compute or inference services to entities or individuals sanctioned by the U.N., OFAC or Canada's SEMA; assisting money laundering.
  • Platform abuse: evading billing, bypassing API key limits, mass top-up bonus harvesting, multi-account arbitrage, constructing adversarial examples to attack the moderation system, automated bulk spam requests.

  • Adult content (NSFW): most upstream models disable NSFW; the Platform disables it by default. If an adult model is launched in the future under compliance review, it will be opened only through a separate KYC channel. At present this is treated as prohibited.

5. 内容审核流程/ 5. Content Moderation Process

本平台对所有调用执行多层审核: (a) 客户端关键词预检 (实时阻断高风险词汇); (b) OpenAI moderation API (服务端 prompt 与上传素材审核, 同步阻断); (c) 上游 provider 内部审核 (异步, 上游可能基于其内部策略拒绝并返回 422 MODEL_REJECTED); (d) 抽样人工复审 (违规告警 / 投诉触发).

审核结果分为: PASS / WARN (灰区, 仍允许但记入审计日志) / SOFT_BLOCK (建议用户修改 prompt, 不扣 credits) / HARD_BLOCK (直接拒绝并记入风控分数).

对审核结果有异议的, 您可通过 abuse@qihuaai.com 申诉, 提供 call_id 与上下文; 我们承诺 24 小时内首次响应, 3 个工作日内决定.

The Platform applies multi-layer moderation to every invocation: (a) client-side keyword pre-check (real-time blocking of high-risk terms); (b) OpenAI moderation API (server-side prompt and upload review, synchronous block); (c) upstream provider internal moderation (asynchronous; upstream may reject with 422 MODEL_REJECTED under its own policies); (d) sampled manual review (triggered by alerts or reports).

Moderation outcomes: PASS / WARN (gray area, allowed but logged) / SOFT_BLOCK (suggest the user revise the prompt, no credits charged) / HARD_BLOCK (rejected outright and recorded as a risk score).

If you disagree with a moderation decision, you may appeal via abuse@qihuaai.com with the call_id and context. We commit to a first response within 24 hours and a decision within 3 business days.

6. 违规处置阶梯/ 6. Violation Escalation Ladder

  • 一级 (轻度): 例如灰区 prompt 触发审核, 输出含轻微违规内容. 处置: 警告 + 删除该次输出 + rate_limit 减半 24 小时 + 记录风控分.
  • 二级 (中度): 例如 24 小时内 3 次一级违规、或单次明显尝试规避审核. 处置: 24-72 小时账号冻结, 期间所有调用拒绝, 不退还期间已发生 credits.
  • 三级 (重度): 单次触发第 2 条 "绝对禁止" 中任一项. 处置: 立即永久封号 + 退还未消耗 credits (无溯及, 即已消耗部分不退) + 记录至上游 provider 黑名单 + 涉及刑事的移交执法机关.
  • 申诉: 一级、二级处置可在 7 天内通过 abuse@qihuaai.com 申诉; 三级处置 (尤其涉及 CSAM、恐怖主义、未授权深度伪造) 不接受常规申诉, 仅在用户能证明本人账号被盗用的情况下进行合规复审.
  • Tier 1 (minor): gray-area prompts triggering moderation, outputs containing minor violations. Action: warning + removal of the output + rate_limit halved for 24 hours + risk-score record.
  • Tier 2 (moderate): e.g. three Tier-1 violations within 24 hours, or a single clear attempt to bypass moderation. Action: 24-72 hour account freeze, all invocations blocked, no refund of credits consumed during the freeze.
  • Tier 3 (severe): any single violation of Section 2 ("Strictly Prohibited"). Action: immediate permanent ban + refund of unused credits (no retroactivity; already-consumed credits are not refunded) + entry on upstream provider blacklist + referral to law enforcement for criminal matters.
  • Appeals: Tier 1 and Tier 2 actions can be appealed within 7 days via abuse@qihuaai.com. Tier 3 actions (especially involving CSAM, terrorism, or unauthorized deepfakes) are not subject to ordinary appeal; compliance review is only conducted where the user proves the account was compromised.

7. 滥用举报与 24 小时响应承诺/ 7. Abuse Reporting and 24-Hour Response Commitment

如您发现疑似违规内容、账户或调用 (本平台用户或第三方分发渠道上看到的奇画 AI 水印作品), 请立即邮件至 abuse@qihuaai.com, 提供以下信息: (a) 违规内容链接 / 截图; (b) 违规类型 (参照第 2 条清单); (c) 您与违规内容的关系 (受害者 / 知情人 / 一般举报者); (d) 您的联系方式 (匿名举报亦可).

响应承诺: CSAM 类报告 4 小时内首次响应 + 24 小时内移除并报送 NCECC / NCMEC. 其他类别 24 小时内首次响应 + 3 个工作日内决定.

对于法律强制要求披露的情形 (合法传票、法院命令、紧急安全请求), 我们将根据所在司法管辖区法律配合执行. 除非法律禁止 (例如刑事保密令), 我们将在合理范围内通知被披露用户.

If you discover suspected violating content, accounts or invocations (qihuaai.com users or qihua-AI-watermarked outputs on third-party distribution channels), please email abuse@qihuaai.com immediately with: (a) link or screenshot of the violating content; (b) violation type (refer to the Section 2 list); (c) your relationship to the content (victim / informant / general reporter); (d) your contact information (anonymous reports are also accepted).

Response commitments: CSAM reports receive a first response within 4 hours plus removal and reporting to NCECC / NCMEC within 24 hours. Other categories receive a first response within 24 hours plus a decision within 3 business days.

Where disclosure is legally required (valid subpoena, court order, emergency safety request), we will cooperate in accordance with the laws of the applicable jurisdiction. Unless prohibited by law (e.g. criminal gag orders), we will notify the affected user where reasonable.
